1. Who we are

This website is operated by HollowHour ("we", "us", "our"), located in Panama City, Panama. Throughout these terms, "you" means the visitor or customer using this site. By visiting our site or buying something from us, you agree to the terms set out below. If you do not agree with them, please do not use the site.

2. Eligibility

You must be at least the age of majority in your country, or have the consent of a parent or guardian, to place an order. You may not use our products for any unlawful purpose, and you may not breach any law in your jurisdiction, including copyright law, in the course of using the site.

3. Products and pricing

All prices are shown in United States dollars and include no import duties or local taxes unless stated at checkout. We have made every effort to display our products accurately, but colours and finishes may vary slightly depending on your screen, and dimensions are approximate.

We reserve the right to change prices, modify products, or discontinue any item at any time without notice. We also reserve the right to limit quantities or to refuse any order. If we cancel an order you have already paid for, we will refund you in full.

Occasionally a product may be listed at the wrong price or with an inaccurate description because of a typographical error. If that happens we may cancel the affected order and refund you, even after the order has been confirmed. We will always contact you first.

4. Orders and payment

Placing an order is an offer to buy. Our acceptance of that offer happens when we dispatch the goods, not when you receive an order confirmation email. Payment must be received in full before dispatch.

You agree to provide current, complete and accurate purchase and account information for every purchase made on our site, and to update it promptly so that we can complete your order and contact you if needed.

We may refuse or cancel an order that appears fraudulent, that comes from a reseller or distributor, or that we cannot fulfil.

5. Shipping and delivery

Delivery is governed by our Shipping Policy, which forms part of these terms. In short: we ship to a defined list of countries, shipping is a flat US$9.99 and free over US$99, and delivery typically takes three to six weeks because our goods ship internationally. Import duties and local taxes, where they apply, are your responsibility as the importer.

Risk of loss passes to you on delivery. Where a parcel does not arrive within 45 days of dispatch, we treat it as lost and will replace or refund it.

6. Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these terms. Nothing in these terms removes or limits any statutory right you have as a consumer, including the right of withdrawal available to consumers in the United Kingdom and the European Union.

7. Accuracy of information on this site

We are not responsible if information made available on this site is not accurate, complete or current. The material here is provided for general information only and should not be relied upon as the sole basis for making decisions. Any reliance on it is at your own risk. Historical information on the site is provided for reference and may not be current.

8. Third-party services and links

Our site is hosted on Shopify and uses third-party services for payment, analytics and fulfilment. Links to third-party sites are not under our control, and we are not responsible for their content, accuracy or practices. Please review their policies before engaging with them.

9. Your comments and submissions

If you send us ideas, suggestions, reviews or other material, whether at our request or not, you agree that we may use, edit, copy and publish it without restriction and without obligation to compensate you. You agree that your submissions will not violate anyone else's rights and will not contain unlawful, abusive or defamatory material, and that they do not contain computer viruses or malware.

Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.

11. Prohibited uses

You may not use this site for any unlawful purpose; to solicit others to perform unlawful acts; to infringe our or anyone else's intellectual property rights; to harass, abuse, defame or discriminate; to submit false information; to upload malicious code; to collect or track the personal information of others; to spam, phish, or scrape; or to interfere with the security features of the site. We may terminate your use of the site for breaching any of these.

12. Disclaimer and limitation of liability

We do not guarantee that your use of the site will be uninterrupted, timely, secure or error-free. Except where prohibited by law, and except in respect of death or personal injury caused by our negligence or any liability that cannot lawfully be excluded, our total liability to you in connection with any order is limited to the amount you paid for that order.

Nothing in this section affects your statutory rights as a consumer.

13. Indemnification

You agree to indemnify and hold harmless HollowHour and its officers, contractors and agents from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your violation of any law or the rights of a third party.

14. Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

15. Changes to these terms

We may update these terms at any time by posting a revised version on this page. It is your responsibility to check this page periodically. Your continued use of the site after changes are posted constitutes acceptance of those changes.

16. Governing law

These terms are governed by the laws of the Republic of Panama. Where you are a consumer resident in the United Kingdom or the European Union, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings in your local courts.
